The Privacy Policy agreement, together with the Terms and Conditions, represents the entire agreement between you and us in relation to your use of flashbackr.
1. INTERPRETATION
The following definitions shall apply in this agreement.
Flashbackr: refers to the flashback website and the flashback suite of applications (desktop, browser extensions and mobile applications)

Flashbackr, excluding user uploaded content is operated by Flashbackr Ltd., a company registered in England and Wales with company number 08112492 whose registered office is at 29 St Johns Rd, NW11 0PE, London, UK.
Our licensors and we own the copyright in flashbackr (including, without limitation, the text, applications’ source code, artwork).
3. INFORMATION WE COLLECT
You are required to create a user account to use flashbackr.
During registration, you are required to provide a name, password and valid email address.
If you choose to share the content in your flashbackr account with another person, we might ask you to provide a valid email address for that person. We may also ask you to provide your name and password for third party websites in order to access the articles and information published on such sites. We also collect information if you contact us for support or help, submit an application or otherwise communicate with us.
We collect, store and use information about your use of flashbackr, including how and how often you use the service, which devices you use to access flashbackr. We compile aggregated data by combining information from many users, without including any information that could be used to identify you or anyone else.
If you add content to your flashbackr that has been previously uploaded by you or another user, we may associate all or a portion it with your account rather than storing a duplicate.
We collect, store and use information relating to any transactions carried out between you and us on or in relation to this website, including information relating to any purchases you make of our services.
When you invite others to join flashbackr by using our referral system, we send them a one-time email for that referral. You may also provide us with your contacts’ email addresses when sharing folders or files with them. We may also receive personal Information (for example, your email address) through other users, for example if they have tried to share something with you or tried to refer flashbackr to you. Before you disclose to us the personal information of another person, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with the terms of this Privacy Policy. We will not be liable for the provision of information of any third person (see Terms and Conditions 4. and 5.).
4. USE OF YOUR PERSONAL INFORMATION
Personal information submitted to us via this website will be used for the purposes specified in this Privacy Policy or in relevant parts of the website.
We may use your personal information to administer your flashback account, improve your browsing experience by personalising the website, provide to you services purchased from us, keep the website secure and prevent fraud.
We may use your personal information for location-based search through your content. Whenever location information is available, for instance from your devices’ GPS coordinates, we will collect and append the location information to the content you save. Also, some of the information we collect from a Device, such as an IP address, can sometimes be used to approximate a Device’s location.
We may use your personal information to collect payments from you and enable your use of the chargeable services available through flashbackr.
We can send you invoices, general (non-marketing) commercial communications and email notifications that you have specifically requested.
5. DISCLOSURE OF YOUR PERSONAL INFORMATION
We may disclose your personal information to any of our employees, agents or subcontractors, insofar as reasonably necessary for the purposes set out in this Privacy Policy.
We may disclose your personal information in connection with any on-going or prospective legal proceedings and in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
Your personal information may be provided to third parties in order deal with enquiries and complaints made by or about you relating to the website.

You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
You are responsible for keeping all your login details confidential.
7. COOKIES
A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. This enables the web server to identify and track the web browser.

Our payment services providers may also send you cookies.
8. OPT-OUT
If you have signed up to receive email from us and, or if someone has asked us to share content with you, and you would like to avoid receiving such emails in the future, you may opt-out of receiving them by using the unsubscribe feature on any of our email correspondences. We will try to communicate with you only according to your instructions, although it may take some time to process your requests.
9. UPDATING AND DELETING INFORMATION YOU PROVIDED
We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, you may delete your account from the settings pane. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion. In addition, we do not delete from our servers files that you have in common with other users.

10. POLICY AMENDMENTS
We may update this Privacy Policy from time to time by posting a new version on our website. You should check this page occasionally to ensure you are happy with any changes.
We will also notify you of changes to our Privacy Policy by email.
All amended terms shall automatically be effective thirty (30) days after they are initially posted on the Website. If we make any material changes to our Privacy Policy that affects users’ information already stored in our database, we will post a prominent notice on our Website notifying users that our Privacy Policy has changed. Our use of your information shall be governed by the Terms and Conditions of our Privacy Policy in effect when you first use our application or thirty (30) after the terms are changed, as explained above.
If any part, term, or provision of this Policy shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.
Any person who is not a party to this Privacy Policy has no rights under any applicable legislation to rely upon or enforce any terms of this policy.

This Privacy Policy will be governed by and construed in accordance with English law, and any disputes relating to this disclaimer will be subject to the jurisdiction of the courts of England and Wales.
